AMENDATORY ORDER 
  

Upon the application of plaintiffs for a partial recon- 

sideration of our Memorandum Order dated January 26, 1979, for 

determination of legal services rendered by plaintiffs' counsel 

performed since March 2, 1976, the court has recomputed the sums 

claimed and agrees that a miscalculation was made in the time of 

Melvyn R. Leventhal for post-March 2, 1976 services. The court 

finds the correct amount of hours expended by Leventhal after said 

date was 43.25, from which the court deducts 6 hours claimed by 

said attorney for a motion to amend this court's prior judgment 

concerning the allowance of attorney fees, which motion was 

denied by us and upheld on appeal. Excluding 6 hours uncompens- 

able time, Leventhal should be paid for 37.25 hours and not 14.75 

hours as heretofore held. Calculated at the rate of $40 per 

hour, this increases the award to Leventhal from $590 to $1,490. 

The other portions of the award for fees and costs remain 

unchanged. Thus the corrected fee award should be $3,100, plus 

$553.50 reimbursable costs. 

It is therefore 

ORDERED AND ADJUDGED 

That Melvyn R. Leventhal and Bill Lann Lee, attorneys 

for the plaintiff class, do have of and recover from Governor 

Cliff Finch, Charles E. Holladay, Jean McCool, Larry Tynes, 

 



  

T. M. Stone and W. A. Matthews, constituting the members and 

executive secretary of the Mississippi State Textbook Purchasing 

Board, and their successors in office, the sum of $3,100 as legal 

fees and $553.50 as reimbursable costs, plus interest from 

January 26, 1979, at the rate of 8% per annum until paid. 

For which let execution issue.
