OFFER OF JUDGMENT 
  

Comes Calhoun County, Alabama, and its various represen- 

tative individuals and offer judgment pursuant to FRCP 68 as 

follows: 

1. The Calhoun County Commission shall consist of [four 

members to be elected from single member districts by the voters of 

each district. 

2. The districts shall be equal, as nearly as practicable, 

in population. 

3. The districts shall be drawn by agreement of the 

parties. 

4. Failing agreement between the parties on the district 

lines, each shall submit to the Court its proposal and the Court 

shall select one or shall order its own plan. 

5 Compensation of Commissioners shall be as otherwise 

provided by law. 

6. There shall be a Chairman of the County Commission 

elected by all the voters of the County. 

7. The Chairman of the County Commission shall be the 

chief executive of the County, shall preside at Commission meetings 

and shall be responsible for the execution and implementation of 

the policies adopted by the Commission.

8. The Chairman of the County Commission shall not be 

entitled to vote at Commission meetings except in the case of a tie 

among the Commissioners. : 

9, The Chairman of the County Commission shall not be 

permitted to make or second motions at meetings of the Commission. 

10. Compensation of the Chairman of the County Commission 

shall be as otherwise provided by law. 

11. Calhoun County shall secure the introduction and 

legislation to formalize this agreement and shall submit it to the 

United States Justice Department for preclearance under the Voting 

Rights Act; however, upon appropriate order of the Court in this 

case, it shall implement the terms of this offer immediately. 

12. Calhoun County will pay the cost (including attor- 

neys' fees) taxed to it by the Court.
