Dear Mr. Fuhrman:
I have your letter of January 21, 1974 in the 

above matter. Representing one of the Respondents, the 
Detroit Board of Education, I not only will not consent 
but I will forthwith file a motion to dismiss any 
brief that you file on the grounds that the brief is 
not timely filed. Any brief that you had intended to 
file was due on January 3, 1974. An attempt on your 
part to file a brief at this time would be prejudicial 
to my client as we have not had the opportunity to 
review the brief during the thirty-day period that we 
were permitted to file the reply briefs. Therefore, you 
can expect no consent from us, and you can expect a 
motion to dismiss because your brief is untimely.
