DEFENDANT'S RESPONSE TO PLAINTIFFS’ 
FIRST REQUEST FOR ADMISSION TO 

UNITED STATES SECRETARY OF HEALTH, 
EDUCATION AND WELFARE 
  

Defendant Joseph A. Califano, by his undersigned attorneys, 

pursuant to Rule 26(a) of the Federal Rules of Civil Procedure 

hereby responds to plaintiffs' request for admissions as follows: 

(a) Admit. 

(b) Admit. 

(c) Admit that this is the policy utilized in the adminis- 

trative investigation of Wilmington Medical Center in which the 

satellite hospital has not yet been constructed. This policy 

was developed in May, 1977. The Director of the Office for 

Civil Rights, Mr. David Tatel, is reviewing the entire site 

relocation policy and its application to hospitals which have 

previously been relocated.
