herewith photocopy of Assistant Attorney General J. Stanley
Pettinger's letter to Mr. Kenneth C. DeJean of November 26,
1974.
I am enclosing copies thereof with copies of this
letter to Messrs. Pugh, Dennery and Quigley.
Please be further advised that in response to your
inquiry as to the status of the legislative bill relating to a
Missouri-type plan, the matter passed out of committee four to
one favorably on May 30. It was brought up on the same day
under a special order that they were four votes short of the
required two-thirds majority for a constitutional amendment and
the bill remains viable, but with no further action having been
taken thereon.

This is in reference to your submission of the
Louisiana State Constitution submitted to the Attorney
General pursuant to Section 5 of the Voting Rights Act
of 1965. Your Dui/mission was received complete (with
the exception of tbe additional information requested,
but not yet received, concerning Article VIII, Section
10(b)), on October 31 1974.
The Attorney General does not int8rpOae at
objection to the coppleted part of the submission.
However, no decision yet can be made with regard to
Article VIII, Section 10(b). We feel a responsibility
to point out that the failure of the Attorney General
to object to the completed part of the submission does
not bar any subsequent judicial action to enjoin the
enforcement of such changes. We also would like to
cell to your attention that our review of Article
VIII-Education, for which the Eubcistion is complete,
considered Fifteenth Anendment aspects of the submis-
sion only and should not be construed to be a deter-
mination of any other issues arising under federal law.
