Hon. Gilbert F. Ganucheau
Clerk
United States Court of Appeals for
the Fifth Circuit
600 Camp Street
New Orleans, Louisiana 70130

Re: No. 87-3463, Chisom v. Edwards

Dear Mr. Ganucheau:

I represent the appellants in this case. At oral argument,
on December 10, 1987, I was asked a question regarding the status
of the other cases concerning the question whether section 2 of
the Voting Rights Act of 1965 as amended, 42 U.S.C. 1973,
applies to judicial elections. At that time, there had been no
decisions on that question by a court of appeals.

One week ago, the Court of Appeals for the Sixth Circuit
held that section 2 does apply to the election of judges.
Mallory v. Eyrich, No. 87-3838 (Jan. 12, 1988). I am enclosing
four copies of its slip opinion. Pages 5-13 contain the relevant
discussion.

I would appreciate your circulating this letter and the
opinion to the members of the panel which heard our case--Judges
Johnson, Higginbotham, and Brown.

I have also served a copy of this letter and the opinion on
all counsel of record.

Pa S. Karlan
Counsel for Plaintiffs-
Appellants
