MOTION TO SHORTEN TIME

Plaintiffs move the court pursuant to Rule 33(a), Federal

Rules of Civil Procedure, for an order directing defendants to

answer plaintiffs’ second discovery request by Friday, February

28, 1986. As grounds for this motion, plaintiffs would show:

1. Plaintiffs’ second discovery request, filed on February

18, 1986, seeks to discover any knowledge defendants might have

regarding the legislative history for the various county

commissions throughout the state. To do this, plaintiffs first

set out what they believe constitutes the complete legislative

history for each county commission. Plaintiffs then request that

each defendant identify any mistakes or errors of which they have

knowledge, for their own county and for any other county.

2. Defendants will not be burdened by this request since it

only seeks defendants’ knowledge of errors in plaintiff's

legislative history.

3. The hearing on preliminary injunction is set in this case

for Tuesday, March 4, 1986. Plaintiffs need this information in

order to adequately prepare for that hearing.

WHEREFORE, plaintiff prays the court will enter an order

requiring defendants to answer plaintiffs’ second discovery

request no later than Friday, February 28, 1986.

Q Th
Respectfully submitted this [2 day of February, 1986.
