INDICTMENT NO. S a l a l a t a ‘CHARGE: MURDER MOTION TO SUPRESS ILLEGALLY SEIZED EVIDENCE COMES NOW the accused, WILLIAM HENRY FURMAN, and moves to suppress illegally seized evidence, showing that: - “1. Accused was arrested without a warrant on August 11, 1967, at approximately 2:30 a. m. by officers AL. Hall, Waters and Goode of the Savannah Police Department. 2.. At the time of his arrest, accused was found under a house at 5020 Temple Street, Savannah, Chatham County, Georgia. 3+. The arresting officers had nearby several other officers of the Savannah Police Department. In addition, they were armed and had constant radio contact with police head- quarters. | 4 ‘No offense was committed by accused in the pre- sence of the arresting officers or any other officers of ghe law. 5. If, in fact, said officers had grounds to arrest accused, they had ample opportunity to obtain a warrant therefor. 6. Incidental to his arrest, certain articles were illegally seized from accused without a search warrant and with- out his permission. Articles so seized included one (1) 22 pistol bearing serial number 28652. | | | 7. Also as a result of this illegal arrest, the per- son of the accused was used to obtain evidence against him by means of laboratory tests and police identification procedures such as photograph, fingerprints. 8o No having benefits of discovery proceedings, accused does not know what other evidence the State may have obtained as a result of this illegal arrest and illegal search and seizure, but asks also that he be given opportunity to in- quire therein and to have such other evidence also suppressed. 9. Said arrest, search and seizure were illegal in that they violated Ga. Code S 27-207 and constituted an unreeson- able sesrch and seizure in contravention to the Fourth Amendment to the Constitution of the United States and Paragraph XVI, Section I, Article I, of the Constitution of the State of Georgia.
