Any person who votes more than onee at any election held in this state, or
deposits more than one ballot for the same office as his vote at such election,
or knowingLy attempts to vote when he is not entitled to do so, or is guilty oi
a-ny kind of illegal or fraudulent voting, must, on conviction, be impri"sonei in
the penitentiary for not less than two nor more than five years, at the discretion

Scope of section. - The language of this
seetion is broad enough !o embraee, and in fact
does in ipsis verbis embrace, "any election held
in this state." Gandy v. Stat€,82 Ala. 61, 2 So.
465 (188?). See also Anderson v. State, 72 Ala.
187 (1882); Washington v. State, ?5 Ala. 582
0884).

"Election" defined. - The word ,,election,'
nreans the aet of casting and reeeiving ballols,
and the day and time of voting. State v. Tucker,
54 Ala. 205 (18?5).

Mlrtake ar to qualifleatlonr. - A minor, who
is otherwise duly qualified, eannot be eonvieted
of illegal voting beeause he was not of the
requisite age, if he voted under the honest belief,
indueed by information from parenls, relations
or acquaintances having knowledge of the time
of his birth, that he had attained his majority.

However, if one votes reeklessly, or
earelessly, when the faets are uneertain or
doubtful, his ignoranee will not exeuse him.

The poll llsts are the hlghest and best
evldence of who voted at an election. Wilson v.
state, 52 Ala. 299 08?5). See also Hunter v.

Sufflcleney of lndletment. - A count of an
indictment ehnrging that the defendant, not
being 2l years (now l8 years) of age, voted at
a given general election held in this state is
suffieient. Gordon v. State, 12 Ala. l0g 08?S).

E 17-23-2. Illegal voting at municipal elections.

Any person who falsely impersonates another and thereby or otherwise
fraudulently casts a vote to which he is not entitled, or having voted at such
municipal election votes a second time, whether in the same ward or another,
or having once obtained registration in any ward, shall cause himself to be
registered a second time, or attempts to obtain a second registration, whether
in the same or another name, or whether in the same or another ward, or shall
aid or assist another not so entitled, knowing him not to be so entitled, to vote
or to obtain registration as a voter, shall be guilty of a felony, and, on conviction
in the circuit court, or court of like jurisdiction, of the county, shall be punished
by imprisonment in the penitentiary for a period of not less than one nor more

Any person who, by bribery or offering to bribe, or by any other corrupt
means, attempts to influence any elector in giving his vote, or deter him from
giving the same, or to disturb, or to hinder him in the free exercise of the right
of suffrage, at any election, must, on conviction, be fined not less than $50.00

Any person who buys or offers to buy any vote of any qualified elector at any
election by the payment of money or the promise to pay the same at any future
time, or by the gift of intoxicating liquors or other valuable thing, shall be
deemed guilty of a misdemeanor, and, on conviction thereof, shall be fined not
less than $50.00 nor more than $100.00. (Code 1907, S 6808; Code 1923, 5 3926;

Any qualified elector at any election who takes or receives any money or other
valuable thing, upon the condition that the same shall be paid at any future time,
in exchange for the vote of such elector for any particular candidate, or the
promise to vote for any particular candidate, shall be guilty of a misdemeanor,
and, upon conviction thereof, shall be fined not less than $50.00 nor more than
$500.00. No witness shall be prosecuted for any offense under this section as

(4) Demand, solicit, ask or invite any payment or contribution for any

religious, charitable or other cause or organization supposed. to be primarily
for the public good from any candidate for nomination or election;

(5) Demand, solicit, ask or invite any candidate for nomination or election

for public offrce or party position or any political committee to subscribe for

the support of any club or organization, or to buy tickets to any

entertainment or ball or to pay for space in any book, program, periodical or
publication. This ehall not apply to the solicitation of any business

advertising in periodicals in which the candidate was a regular advertiser
prior to his candidacy, nor to ordinary business advertising, nor to the regu-

iar demands of any organization, religious, charitable or otherwise, of which

he was a member, or to which he was a contributor for more than six months

before his candidacy, or to any ordinary contributions at church services;

(6) For any corporation or person, trustee or trustees, owning or holding

a mqiority o1 stock of a corporation carrying on the business of a bank,

savings bank, trust, trustee, savings indemnity, safety deposit, insurance,

railroad, street railway, telephone, telegraph, gas, electric light, heat or
power company, or any company having the right to condemn land or to
Lxercise franchises in public ways granted by the state, county, city or town,
to pay or contribute any money or value in order to aid or promote the
nomination or election of any person, or in order to aid or promote the

interest or success, or defeat, of any political party or political proposition;

(?) For any business corPoration incorporated under the laws of or doing

business in thie state, or any ofTicer or agent acting in behalfofsuch corpora-

tion, to directly or indirectly give, pay, expend or contribute, or promise to
give, pay, expend or contribute, any money or other valuable thing in order

any question or proposition submitted to the vote of the people, or in order

to aid, promote or antagonize the interests of any political party; or
(8) For any person or persons or political committee to solicit or receive

Notwithstanding the provisions of this section, it shall not be unlawful for

any business or nonprofit corporation, incorporated under the laws ofor doing

business in this state, any officer or agent acting in behalfofsuch corporation,
or any entity described in subdivision (6) of this section, to give, pay, expend

or contribute money, services or anything of value for the purposes of estab'

lishing, administering or soliciting voluntary contributions to a separate,
