This matter is before the Court on Defendanta' Motion 

pursuant to Rule 62 of the Fedaral Rules of Civil Procedure for a 

Stay of its Order of April 3, 13398. 

In that Order the Court, fellowing a hearing, granted 

Plaintiffs’ Motien for Summary Judgment as to the Twelfth 

Congressional District and granted Plaintiffs’ Motian for a 

Preliminary Injunction and Plaintiffa' request for a Permanent 

Injunction. In the instant Motion, the Defsndants request that 

this Court stay the April 3 Order "so that the congressianal 

alections process which have [sic] already began [aic] may 

continue as acheduled." 

The Court how DENIES the Dafendants’ Motion for a fray. As 

gtated in the Court's previoue Order, a Memorandum and Opinion   
{11 be filed forthwith on the merita of ita Order filed at 3 

.m. on April 3, 1998, The Court filed an Order without a 

upporting Memorandum to afford the parties notice of tha Court's 

ruling and to avoid the unnecessary passage of time in the

erafting of a remedy. 

This Order is entered into by a majority of the three-judge 

panel. Cireuit Judge Sam J. Ervin, III, dissents.
