Dear Mr. Ganucheau:
I represent the appellants in this case. At ora.l argument,
on December 10, 1987, I was asked a guestion regarding the status
of the other caaes concerning the question whether section 2 of
the Voting Rights Act of 1965 as amended, 42 U.S.C. S 1973,
applies to judicial elections. At that time, there had been no
decisions on that guestion by a court of appeals.
One week ?9o, the Court of Appeals for the Sixth Circuit
hetd that section 2 does apply to the election of judges.
MalJorv v. Evrich, No. 87-3838 (Jan. 72, 1988). I am enclosing
four copies of its slip opinion. Pages 5-13 contain the relevant
discussion.
I would appreciate your circulating this Letter and the
opinion to the members of the panel which heard our case--Judges
Johnson, Higginbotham, and Brown
I have also served a copy of this letter and the opinion on
all counsel of record.
