Dear Judge Hobbs:

I enclose a copy of Petitioner's t'totion for
Summary Judgment and supporting Memorandum
of l,aw. As this motion was being prepared
for filingr w€ received a copy of the Reply
of Respondents to Petitj.oner's Response to
this Court's Order of December 2, 1983. The
Respondents presumably will argue and raise the
sami contentions in response to Petitioner's
llotion for SummarY Judgment.

We, therefore, await notif ication of .the Court's
preference whether we should answer the Reply of
Respondents or respond to the Respondent's con-
tentions when they answer the t'lotion for Summary
Judgment.

In additionr w€ respectfully request that the
Court schedule a hearing on Petitioner's Ivtotion
for Summary Judgrnent after both parties have had
an opportunity to file Reply Briefs.
