ORDER 

On the day of , 1992, came on to be heard the   

Motion to Intervene by plaintiff-intervenors PUEBLO, ABC, NYCCELP and 

individual plaintiff-intervenors, and the Opposition thereto by 

defendant United States of America. The Court, having considered said 

Motion, defendant United States of America's Opposition, and the 

entire record in this proceeding, and being otherwise fully apprised 

of the circumstances of this cause, is of the opinion that said Motion 

requesting intervention by PUEBLO, ABC, NYCCELP and individual 

plaintiffs/intervenors on behalf of a nationwide class of all 

Medicaid-eligible children presently residing in the United States of 

ORDER -- Page 1 

 



America should be denied. It is therefore, 

ORDERED that plaintiff-intervenors' Motion for Intervention as to 

defendant United States of America is hereby denied. And it is 

further 

ORDERED that Dr. Louis W. Sullivan, Secretary of the Department 

of Health and Human Services, shall be added as a defendant to this 

action.
