Mr. Tim Mustaine
Chambers of

Hon. Patrick F. Kelly
United States District Court
for the District of Kansas
P.O. Box 104
Wichita, Kansas 67201
Dear Tim: .

Please find enclosed the materials regarding
the fleeing felon doctrine that you requested.

I have included our brief in Garner, our
reply brief, the opinion in Ayler v. Hopper,
and a copy of Larry Sherman's piece. I could
not find a copy of the Sherman article as it
appeared in the Vanderbi.lt Law Review. I
believe the copy enclosed is identical. The
citation for the Vanderbilt article is in the
brief.

Please let me know if I can be of any
further assistance.

Steven L. Winter
