Appellants were unable to go forward in the prosecution of 

this appeal until the Court ruled on the Motion of Appellants, 

GADSDEN COUNTY DISTRICT SCHOOL BOARD, et al., to invoke Rule 

28{(L). 

Appellants, GADSDEN COUNTY DISTRICT SCHOOL BOARD, et 

al, hereby elect to defer the preparation of the appendix 

pursuant to Rule 30C, of Federal Rules of Civil Procedure, 

and Fifth Circuit Local Rule 13C.
