T h e  T e s te r  C o n cep t w as e x te n s iv e ly  d iscu ssed  at a 
series o f  union m eetings. On June 28, 1978, the union held 
a special m eetin g  to  v o te  on the T e ste r  C on cept. T he plan 
w as a p p ro v e d  b y  a m argin  o f  n in e ty  v o te s  to  s ix ty —ap­
p ro x im a te ly  the ra tio  o f  m en  to  w om en . A ll th ree  p la in ­
tiffs  a tten d ed  th e  m eetin g , and v o te d  again st th e  plan. 
On July 23, 1979, the union and the em p loyer  en tered  into 
a le t te r  o f  a g reem en t a d op tin g  the T e s te r  C on cep t.

A t  the tim e the T e s te r  C o n cep t w as  a d op ted , L ora n ce  
w as em p loy ed  as a tester. K in g  w as p rom oted  to  a tester  
p os ition  in F e b ru a ry , 1980. B u esch en  ob ta in ed  a te s te r  
jo b  in N o v e m b e r , 1980. B y  the su m m er o f  1982, L ora n ce  
and K in g  had b een  p ro m o te d  to  sen ior  te s te r  position s. 
A t  th at tim e, A T & T  b eg a n  a red u ction  in fo rce , w h ich

1 The district court granted summary judgment without first con­
sidering the plaintiffs’ motion for class certification. This is a viola­
tion of Federal Rule of Civil Procedure 23, which requires the 
district court to decide the question of class certification “ as soon 
as practicable,”  Fed. R. Civ. P. 23(cXl). Although a district court’s 
deliberate decision not to certify a class deprives us of appellate 
jurisdiction, Glidden v. Chromalloy Am erican Corporation, 808 
F.2d 621 (7th Cir. 1986), we are not deprived of jurisdiction in 
a case, such as the present one, in which the district court in­
advertently does not act on the certification motion, see Bennett 
v. Tucker, No. 86-2628, slip op. at 5-6 (7th Cir. Aug. 11, 1987). 
Nonetheless, this case illustrates the problem that may arise when 
a court does not comply with Rule 23. Because the district court 
did not decide the class certification motion, we do not know who 
is bound by our judgment. This may raise a significant res judicata 
problem in any future litigation that may arise out of the defen­
dants’ administration of the tester seniority system.

has a state agency to which employment discrimination complaints 
may be referred. In states that do not have their own agencies, 
the deadline is only 180 days. See 42 U.S.C. § 2000e-5(e) (1982). 
The defendants argue that because the plaintiffs did not make use 
of the existing state procedures, the 180-day period applies. How­
ever, we need not resolve this question, because the plaintiffs’ 
claims are untimely under either standard.
