DAVID TREEN, ET AL SECTION: C (£3

MOTION FOR EXTENSION OF TIME IN WHICH TO FILE
OBJECTIONS TO MAGISTRATE'S FINDINGS AND

RECOMMENDATIONS

NOW INTO COURT, through undersigned counsel, come

plaintiffs in this matter, who respectfully request that they be

allowed until Friday, August 8, 1986 to file objections to the

Findings and Recommendations of Magistrate Alma L. Chasez

regarding the appropriate amount of attorney fees to be awarded

in this matter.

The reasons for this request are many: First, the

Findings and Recommendations of the Magistrate are 61 pages long.

Second, trial counsel for plaintiffs in the attorney fees only

received the findings on July 17, 1986. Third, there are several

recent U.S. Supreme Court cases which bear directly on the issue

before the Court and need to be briefed (including Pennsylvania

v. Delaware Valley Citizens' Council for Clean Air, 54 LW5017).

For these reasons, plaintiffs request until August 8,

1986 to file objections to the Magistrate's Findings.
