Dear Sir:

Pursuant to Rule 34 (5) , the apPellee herewith
reguests an extension of time to and including
Septer,lber 2, 1984, in which to f ile a motion to
dismiss or affirm the appeal taken in this case.
The jurisdictional statement was filed on June
2, 1964 and served upon the aPpellee on June I0,
1984, and unless extended the time for filing
such a motion will expire on July 10, 1984.

This request is made necessary by the fact that
appellee's counsel in North Carolina is scheduled
f;i triat on June 18, 1984, and apPellee's counsel
in New York has previously scheduleo a vacation
for June 27 through July 10, 1984- In addition,
appellee's counsel continue to spend time in this
ciie challenging a portion of the remedy proposed
by appellants. The additional time is therefore
necellary to permit counsel to confer and then to
draft the rnotlon to dismiss or affirm in this i'm-
Portant case.

Appellant's counsel, Kathleen Iieenan t'lcGuan and
l-ames Wallace , Jr. , have consented to thj-s exten-
sion. Appellee believes that this extension will
not unauly delay this Court's consideration of the
appeal and that the Court wiII be able to act upon
the appeal as soon as the new Terrn commences on
October l, 1984.
