Come now the defendants, Methodist Hospital of Gary, Inc. and 

Denis E. Ribordy, by counsel, and move the Court to set their Motions 

to Dismiss previously filed with this Court on the 19th day of 

January, 1977, and on the 6th day of July, 1977, for hearing at 

the earliest convenience of the Court. In support of their motion 

defendants state as follows: 

That defendant, Methodist Hoapital of Gary, Inc. filed a Motion 

to Dismiss in Hammond Civil No. H 76-373 on January 19, 1977; that 

thereafter plaintiffs in Cause No. H 76-373 filed Motions for

Extension of Time extending the time in which to respond to 

defendant's Motion to Dismiss to May 10, 1977; that as of July 26, 

1977, hearing had not been set on defendant's Motion to Dismiss 

in Cause No. H 76-373. 

That on July 6, 1977, defendants, Methodist Hospital of Gary, 

Inc. and Denis E. RiLOLAY, filed their Motion to Dismiss in 

response to the plaintiffs’ Complaint in Hammond Civil No. H 77-154; 

that thereafter on July 12, 1977, plaintiffs filed their Motion 

for Extension of Time in which to respond to Motion to Dismiss 

filed by defendants, Methodist Hospital of Gary, Inc. and Denis E. 

Ribordy, for an extension of one month up to and including August 16, 

1977: that as of July 26, 1977, the defendants' Motion to Dismiss 

has not been set for hearing by this Court. 

That on July 6, 1977, this Court consolidated Cause Numbers 

H 76-373 and H 77-154. 

WHEREFORE, defendants, Methodist Hospital of Gary, Inc. and 

Denis E. Ribordy, respectfully move the Court to set the Motions 

to Dismiss filed in H 756-373 and H 77-154 for hearing at the Court's 

earliest convenience subsequent to August 16, 1977.
