AMENDED ORDER 
  

Upon application of defendant officials for stay without 

posting supersedeas bond from the appeal of the order of this 

court dated January 3, 1978, granting attorney fees and costs 

until the final outcome of the case on appeal, it is 

ORDERED 

That since the judgment herein rendered has been against 

state officials and a state agency who, under state law, may 

appeal without posting supersedeas bond, and Rule 62(f), F. R. 

Civ. P., provides that the benefits available to a judgment 

debtor for stay of execution under state law are available from 

money judgments obtained in federal court, the motion for stay 

without posting supersedeas bond is hereby granted; provided, 

however, that in the event that such Order is affirmed on appeal, 

then the amount of the award so affirmed shall bear interest in 

the amount of 8% per annum from March 2, 1976, until paid.
