RE: United States v. Turner, Hogue and Turner,

Dear Judge Cox and Judge Sims:

By order of March 29,1985, Judge Cox asked Mr. Hogue to notify
the Court whether he intends to adopt the motions filed on his
behalf by his former counsel. By order of the same date, Judge
Sims gave the Government until April 12, 1985 to respond to
cerLain portions of a previously filed Motion for Discovery
with regard to certain "selective prosecution" matters. Because
these matters are related, this }etter will respond jointly to
the two orders.

1,1r. Hogue does not wish to adopt the motions filed by previous
counsel. Rather, he intends to file separate motions on or
bef ore April 15, 1985. l'1r. Hogue inf orms the Court, however,
that he intends to incorporate in his motions much of what is
in his former attorneys' l,lotions for Production and Disclosure
and l'lotion for Severance, dated February 15, 1985, and then to
plead additional matters not contained in these two motions.

I would also like to inform Judge Sims that l'1r. Hogue intends
to file his own motion to dismiss based on selective and
vindicti,ve prosecution and other related matters and a motion
for discovery concerning those matters. I am so informing
Judge Sims in the event that he wishes to take up l'1r. Hogue's
motion for discovery regarding selective prosecution jointly
with the related rnotions previously filed by counsel for I"1r.
Turner.
