Send the following message, subject to the terms on back hereof, which are hereby agreed to October 19, 1970 

Tomorrow (Oct.20) attorneys of the NAACP Legal Defense and Educational 

Fund, Inc, (LDF) will appear in U.S. District Court, Foley Square, 

seeking a preliminary injunction against the holding of tests for 

New York City public school supervisory personnel. LDF attorney 

Mrs. Elizabeth B. DuBois will argue that the examinations discriminate 

against qualified Blacks and Puerto Ricans, that they have never been 

shown to predict a candidate's ability to do the job, and that therefore 

they violate the BM Equal Protection clause of the 14th Amendment. 

The LDF will ask the Court to enjoin the holding of tests scheduled for 

Nov. 3, 1970 and all future examinations which do not have demonstrated 

validity. The N.Y. Association of Black School Supgeevisors and 

Administrators and ASPIRA will seek the Court's acceptance of their 

amicus briefs in support of the LDF position.
