ORDER
The court has before it defendants' motion to vacate
judgment entered on January 3, 1978, awarding attorney fees
against the Mississippi Stalé Tewthook Purchasing Board, an
agency of the State, pending decision of the United States
Supreme Court in Hutto v. Finney, No. 76-1660, cert. granted
October 17, 1977, which concerns, inter alia, the permissibility
of awarding attorney fees pursuant to 42 USC § 1988 against
states and subdivisions thereof in light of the Eleventh Amend-
ment. Since § 1988 is only an alternative reason for the fee
award herein made, and the first ground therefor is 20 USC § 1617,
in which Congress provided specifically for attorney fee awards
against states and subdivisions thereof in litigation such as
that sub judice, it is
ORDERED
That defendants' motion to vacate judgment is hereby
denied.
