Before VANCE, BENDERSON and CLARK, Circuit Judges.

PER CURIAIiI:

Defendants appeal the district courtrs grant of writs

of habeas corpus on plaintiffsr motions for sumnary

judgment.

Both Maggie S. Bozeman and Julia P. t{ilder were

convicted of three counts of vote fraud in state court in

Pickens County, Alabama. Bozenan was sentenced to four

years irnprisonment and Wil,ler to inprisonment for f ive

years. Both were on parole at the time they filed their

petitions for federal habeas in distrlct court.

Apply.ing the standard of Jackson v. Virqinia, 443 U.S.

307 (1979) , the district court held t,hat the evidence

against Bozeman was insufficient to suPPort her conviction

and therefore issued the writ as to her.

The district court concluded that the evidence against

Wilder ras sufficient to sustain her conviction. The court

also held, however, that both petitioners' juries were

instructed on a crlme not charged in their indicEments'

Because of such violation of her sixth amendment rights the

district court also issued the writ aE to Wilder conditioncd

on her retrial within ninetY daYs'

The district court carefully, and we conelude

correctly, ruled on the various contentions of the parties'

We thefore affirn on the basis of the jolnt t'temorandum

- -opinion of the district court dated April 13, 1984.
