CA No. 35257 Dear M r. Lucas: I am today in receipt of your letter of October 25, 1971, in which you requested certain information to be included in our report to the Court on the Magnet School Plan. Even were your request appropriate, the time strictures under which we have been operating make it absolutely impossible to comply with your request and still meet the reported deadline set by the Court. Roth, Judge United States District Court 600 Church Street Flint, Michigan 48502 Re: Bradley, et al. v. Milliken, et al., Civil Action No. 35257 Dear Judge Roth: Enclosed please find a motion pertaining to the report on the Magnet School Plan which defendant Board is required to file by November 3, 1971. Because time is so short, because the facts as evidenced by the correspondence attached to the motion cannot be disputed, and because plaintiffs will have only ten days after the filing of the report within which to file a response, plaintiffs request that the Court rule on the motion at its earliest convenience and without a hearing. We have also enclosed a proposed order. We have exhausted all non-judicial avenues to obtain the information we request, and we regret having to take this matter up with the Court. cc: George E. Bushnell, Esq. Theodore Sachs, Esq. Eugene Krasicky, Esq. Alexander B. Ritchie, Esq. Norman J. Chachkin, Esq. Paul Dimond, Esq. E. Winther McCroom, Esq. Nathanial R. Jones, Esq.
