MOTION FOR IMMEDIATE ISSUANCE OF MANDATE
Appellants, pursuant to Rule 59(2) and (3), re-
spectfully move this Court for an order directing the clerk
of the Court to forthwith issue the judgment (and mandate):
1, June 25, 1973 the Court unanimously held Mis~-
sissippi's textbook loan and distribution statute unconsti~
tutional to the extent that it permitted the distribution
of textbooks to private schools which had a policy or prac
tice of racial discrimination.
2, The private racially discriminatory academies
of Mississippi have been receiving textbooks since their in=-
ception in violation of the Equal Protection Clause; such
unlawful aid will continue through the 1973-74 school year
unless this Court forthwith issues judgment and remands the
case to the district court wherein this Court's decision
can be implemented.
3. Unless this Court's judgment (mandate) issues
forthwith it is entirely likely that relief effective for
the 19/3-74 school year will be impossible.
