RESPONSE OF aMICUS JEFFERSON COUNTY DISTRICT JUDGES 

TO STATE OFFICIALS 'S MOTION FOR JUDICIAL NOTICE 

CF ADJUDICATIVE FACTS 

Amicus Jefferson County District Judges are in agreement with 

the motion of the State (Officials to take judicial notice of the 

facts related in thir motion. However, Amicus Jefferson Count vy 

District Judges would also request the Court to take judicial notice 

of additional facts contalned in their motion For leave to file 

amicus curiae brief granted on fpril 27, 1980. The additional facts 

are contained in exhibit "A" to said motion and may be summarized as 

follows: 

District Judge, 1.7Z2nd Judicial District, a black, was 

unoprosed in the Democratic Primary of March 13, 1880 and 

faces no opposition in the November seneral election. 

Morris lL.. Overstreet, a black, defeated Frank Maloney 

in the Jafferson County fpril 10, 1890 runoff election 

recelving 51.07%. of the votes cast for the Democratic 

nomination for Place 3, Court of Criminal Appeals. 

{(liorris Overstreet did nob win the election state wide.) 

Amicus Jefferson County District Judges believe that these 

additional facts are highly probative and demonstrate the error of

the Dlstrict Court findings concerning minority access 10 the 

election process in Jefferson County.
