CONSENT DECREE BETWEEN PLAINTIFFS 

AND LEE COUNTY DEFENDANTS 
  

This lawsuit was brought by Plaintiffs, Lindburgh 

Jackson, Mrs. Carolyn Bryant and Rev. George Bandy, individually 

anc on behalf of all other black persons similarly situated 

in Lee County, Alabama alleging that the at-large election 

system utilized in Lee County denied, abridged and diluted 

their right to vote pursuant to the Fourteenth and Fifteenth 

Amendments, and 42 U.S.C. sections 1973, 1983 and 1988. 

Pursuant to 23(b){2), P.R.C.P.. The Court has heretofore 

certified the Plaintiffs as representatives of the class of 

all black citizens of Lee County. 

The Defendants are Lee County, Alabama; Hal Smith, 

in his official capacity as Probate Judge; Annette Hardy, in 

her official capacity as Circuit Clerk; and Herman Chapman, 

in his official capacity as Sheriff of Lee County, Alabama. 

The Defendants deny the allegations of the Complaint. 

Prior tO trial on the merits of this case, the parties entered 

into a mutual settlement which the Court has heretofore approved  



  

on an interim basis by Order dated April 14, 1986. The 

Court did not at that time give final approval to the 

proposed settlement since it had not been precleared by 

the Department of Justice pursuant to the provisions of 

Section 5 of the Voting Rights Act of 1965, 42 U.S.C. 

section 1973(c). | 

These parties subsequently filed a Joint Motion requesting 

that the Court approve changes in precincts, election districts 

and polling places in Lee County, Alabama in order to avoid 

elector confusion. The Court approved these changes on an 

interim basis as the changes had not been precleared by the 

Justice Department under the provision above stated. 

The United States Department of Justice has now informed 

the Defendants herein by letter dated May 28, 1986 that the 

Justice Department interposes no objection to the requested 

changes in election of County Commissioners in Lee County, 

Alabama or in the changes in precincts, election districts 

and polling places in Lee County, Alabama. 

The primary election held in Lee County, Alabama on 

June 3, 1986 was held under the provisions of the settlement 

heretofore approved by this Court on an interim basis and 

using the changes in precincts, election districts and 

polling places in Lee County, Alabama heretofore approved 

by this Court on an interim basis. 

THEREFORE, upon due consideration by the Court of the 

record herein, it is ORDERED, ADJUDGED and DECREED as follows: 

 



  

I. Jurisdiction 
  

This Court has jurisdiction of the parties and the 

subject of this action. 

II. Notice 

The Court heretofore approved by order a form and mode 

of Notice to Class concerning the settlement. That order was 

complied with, the Court finds that adequate notice was given 

to the Class and that pursuant to such order and notice, 

Hearing on this matter was held on April 9, 1986 to determine 

the fairness and adequacy of the proposed settlement. After 

such Hearing the Court determined that the proposed settlement 

is fair, just and equitable. 

111i. The Election Process 
  

It is HEREBY ORDERED that the Defendants Lee County; 

Hal Smith, in his official capacity as Probate Judge; Annette 

H. Hardy, in her official capacity as Circuit Clerk; and, Herman 

Chapman, in his official capacity as Sheriff of Lee County, their 

agents, attorneys, employees and those acting in concert with 

them or at their direction are ENJOINED from conducting the 

electicns for the Lee County Commission under the present 

at-large election system, and are FURTHER ENJOINED as follows: 

1. The elections for the Lee County Commission to be 

held in 1986 will be held from single-member Districts, the 

boundaries of which shall be as shown by the map attached 

as Exhibit "A" and as described in Exhibit "B", both attached 

to the proposed Consent Decree heretofore filed in this cause.

2. In the 1986 elections, Commissioners shall be 

elected for single-member Districts 2, 4 and 5 as shown 

by said Exhibits "A" and "B". The two incumbent at-large 

Commissioners who presently reside in the new Districts 

1 and 3 and whose terms do not expire until January 1989 

shall complete their terms and the first elections for 

said Districts 1 and 3 shall be held in 1988. When the 

newly elected single-member District Commissioners take 

Office in January, 1987, the Lee County Commission shall 

consist of five Commissioners elected for four year terms. 

The Probate Judge shall continue to serve as Chairman of 

the Lee County Commission but shall have no vote. 

3. The Lee County Commission shall be empowered to 

appoint a full time County Administrator. 

4. The changes in precincts, election districts and 

polling places as shown on Exhibit "A" attached to a Joint 

Motion filed by the parties herein on April 30, 1986 are 

approved by the Court. The Lee County Commission has the 

authority to make such changes provided same are made more 

than 90 days before the election at which they are to be 

effective and this authority continues unchanged by this 

order of the Court and subject only to preclearance by the 

United States Department of Justice under Section 5 of the 

Voting Rights Act of 1965, 42 U.8.C. Section 1973(c). 

5. The Plaintiffs are prevailing parties for the 

purpose of the award of attorneys fees and expenses. The 

parties shall attempt to negotiate and settle the amount of 

attorneys fees and expenses, but if no agreement is reached 

 



  

after 45 days from the date of final approval of this decree 

the Plaintiffs may file a Motion for attorneys fees and 

expenses with supporting documentation. Defendants shall 

file a response to said Motion, identifying those portions of 

the fees to which they object and those portions they admit, 

The parties may conduct such discovery as may be indicated. 

Thereafter the Court will schedule a Hearing on the Motion at 

the earliest practicable date. 

6. The plan for election of Lee County Commissioners 

which is ordered into effect by this decree shall remain in 

effect only until such time as the Legislature of Alabama 

adopts a plan which meets the requirements of the laws and 

Constitution of the United States.
