on the 16th day of March, 1977 at 9:00 A.M. for the purpose of 

inspection and production of documents pertinent to an action 

pending In the United States District Court for the Northern Dis- 

trict of Indiana, Hammond Division as described above, and bring 

 



with you any and all documents in your possession or control or in 

  

the possession or control of the Medical Center of Gary, Inc. and 

described as follows: 

1. Any and all written, printed, typed or photocopied 
papers, studies, documents, articles, minutes, letters, 
and ledgers which purport to compare the various ser- 
vices offered by the defendant, Methodist Hospital of 
Gary, Inc. at its Gary site and the services offered 
by the defendant at its Broadway site. 

2. Any and all written, printed, typed or photocopied 
papers, studies, documents, articles, minutes, letters. 
and ledgers which detail or describe the meetings of 
the Medical Staff of Methodist Hospital of Gary, Inc. 
held on December 1, 1966 and on January 9, 1967, or 
otherwise describe the membership and activities of 
that Medical Staff in December 1966 and January and 
February of 1967. 

3. Any and all written, printed, typed or photocopied 
papers, studies, documents, articles, minutes, letters 
and ledgers which indicate, describe or document the 
"announced plans" of Methodist Hospital of Cary, Inc. 

with regard to the funds to be collected by the Gary 
Joint Hospital Fund, Inc. 

4. Any and all written, printed, typed or photocopied 
papers, studies, documents, articles, memoranda, 
minutes, letters and ledgers which indicate, describe . 
or document any actions taken by the defendant, 
Methodist Hospital of Gary, Inc. since December 1, 
1966 which demonstrated its intent to deprive the 
black citizens of Gary, Indiana of adequate medical 
services. 

5. Any and all written, printed, typed or photocopied 
papers, studies, documents, articles, memoranda, 
minutes, ledgers and letters which indicate, describe 
or document the actions (whether previously taken or 
contemplated) and position of the Medical Center of 
Gary, Inc. with regard to the initiation, preparation, 
perpetuation and pursuance of and the payment of costs 
of any law suit against the Methodist Hospital of 
Gary, Inc. or any officers or directors thereof or 
against the United States of America or any officers 
or agents thereof. 

You are entitled to security against damages or payment 

of damages resulting from the request for the production of docu- 

ments and may respond to such request by submitting to its terms, 

by proposing different terms, objecting specifically or generally 

to the request by serving a written response to Hodges, Davis,

Gruenberg, Compton & Sayers within ten (10) days or by moving 

to quash the Subpoena as permitted by Federal Rules of Civil 

Procedure Rule 45.
