Consistent with the Court's ruling on September 22, 

1989 and Plaintiffs/Intervenors Oliver, et al.'s offer of 

rebuttal evidence, the following constitutes the sworn offer of 

proof of Jesse Oliver, et al. made pursuant to Rule 803(24), 

Federal Rules of Evidence. Such offer would constitute the 

testimony of the indicated persons, should same be admitted into 

evidence.

States District Court for the Northern District of Texas, Dallas 

Division, testimony by deposition was taken of the following

If such testimony was admitted into evidence, same 

would demonstrate the following: 

"The Republican Party of Texas, through Chet 

Upham, State Party Chair, called upon Court of Appeals Justice 

Patrick Guillot to recruit Dallas County Republican District 

judges who were appointed by Governor William Clements to assist 

 



in the Republican Party of Texas Ballot Security project. The 

Republican District judges in Dallas County recruited by Justice 

Guillot were to post warning signs in Dallas voting precincts. 

The district judges recruited and who posted signs in Dallas 

County included Judges Craig Enoch, Sidney Fitzwater and Jack 

Hampton." 

"The sign to be posted by these Republican 

District judges stated, in part, in large red letters that 'YOU 

CAN BE IMPRISONED' and recited several general categories 

allegedly representing provisions of the Texas Election Code 

and/or Texas Penal Code. The sign concluded in large red 

letters with 'DON'T RISK IT, OBEY THE LAW'. These signs were 

to be posted by the above mentioned Republican District judges 

in Dallas County as well as deputies of the Dallas County 

Sheriff's Department in forty-three (43) precincts generally in 

the northern half of the county and in twenty-eight (28) 

precincts in the southern area of the county in predominantly 

black voting precincts.

errands, 1 came back to my office and there were 

signs laying on thas floor in my office, the kind 

*hat you described with a letter from Judge 

Guillot indicating that he wanted volunteers to 

ost the: sions. Sheriff Byrd and David Dean, 

Secretary of State, had approved posting of signe

paid attention to was who had approved the

I told him I didn't have time to go post a lot of 

signs but he and 1 are personal friends and I

Judge Enoch questions about the relationship with 

Mosely and so forth, but in our last deposition 

there would seem to be a great deal of confusion

noon and Judge Guillot walked up, told me he had a 

job for ma.

standing there reading a magazine wien he came up. 

Q You obviously know Justice Guilliot? 

8 Yaah, he's an old frioznd. I might add, 

we ware both of us candidates on the Republican 

Dallot in 1972. We worked hard during that lection 

togethear., 

{ You got ve know each other pretty well 

A He got out a joint political newspaper 

togatior, 

+} Is that when you I guess began your 

close association with Justics Guillot? 

A Judges Ovard, Judge Cuillot,nyseclf and 

Craig Fowler were four Republican judicial candidates 

in 1278 throughout that year, we worked on a joint 

basis in sharing the expsnsa. fe got out a naswspaper 

which wo thought was very effective that year. It got 

two of us elected. And I began a close association 

with Judge Guillot at that time.

that we're going to put out and we are going to try 

to hit cartain precincts, and he handed me the list 

and it had three precincts circled, that he said 

that he would appreciate ny halping out.

A I don't remember him -- he said there
