MOTION FOR AN ORDER DIRECTING 

THE ISSUANCE OF THE MANDATE 

This motion is filed pursuant to Rules 27 and 41 of the 

Federal Rules of Appellate Procedure. 

1. This case was argued before the Court in May, 1966, 

and decided March 6, 1969; 

2. Defendants-appellees filed a Petition for Rehearing 

en Banc on March 19, 1969. 

3. This Court has made it abundantly clear that the 

school year 1969-70 is the target date for the implementation 

of Green. 

4, If this Court fails to immediately order the issuance 

of a mandate in this case, plaintiffs, who had been awaiting 

the decision of this Court since 1966, will again be asked to 

wait, this time until the 1970-71 schocl year. 



WHEREFORE, appellants respectfully pray that the court 

enter an order directing the mandate to issue.
