The execution of _ Warren McCleskey has been scheduled 

for September 24,1991 at the Georgia 

Diagnostic and Classification Center, Jackosn, Gerogia. 

  

  

In the event the execution is carried out, Warren McCleskey 

has requested that you be present at this scheduled execution. In 

accordance with Georgia Law, this wish is conveyed to you; however, it 

should be pointed out that your attendance is in no way compelled and is 

totally voluntary. 

  

Should it be your desire to be present at this scheduled execution, you 

must sign and return the enclosed acknowledgement to the Superintendent's 

Office at Georgia Diagnostic and Classification Center prior to the 

specified execution time. A self-addressed, stamped envelope for that 

purpose is enclosed. Acknowledgement by telephone to my will be 

acceptable (telephone 404-775-3161) provided the signed acknowledgement 

is presented upon arrival at my office. If you desire to attend, you 

will be contacted by telephone telling you when to present yourself to 

the Superintendent of the Georgia Diagnostic & Classification Center at 

a stated time of the stated date. Please note the conditions and 

stipulations upon your attendance, contained in the acknowledgement, to 

which you will be held should you attend this execution.

execution. I further understand that my attendance is voluntary and 

of my own free will. I further agree to abide by all standards and 

procedures specified by the Superintendent prior to the time of the 

scheduled execution. I understand that no photographs or recording 

equipment 1s allowed in the execution witness room and agree to submit 

to whatever searches may be deemed appropriate by the Superintendent 

of the Georgia Diagnostic and Classification Center. 1 fully 

understand that should by presence or my behavior constitute a 

disturbance or to the proceedings that I may be denied access to the 

execution or may be ejected from same. I further acknowledge that I 

may be denied access to the execution or may be ejected from same if, 

in the judgment of the Superintendent of the Georgia Diagnostic and 

Classification Center arise due to the conduct of actions of others. 

Furthermore, I hereby declare that I shall not hold the State 

responsible for my physical or emotional duress which may occur as 

the result of observing the execution.

COMMUTATION OF SENTENCE OF DEATH 

WHEREAS, a sentence of death has been imposed in the 
case of the State of Georgia vs. Freddie Davis, Case No, 1188 
before the Superior Court of Meriwether County: and, 

  

WHEREAS, through counsel, the Defendant Freddie Davis 
has sought from this Board an order commuting his sentence of 
death to a :.sentence of life imprisonment as authorized by 
Article IV, Section II, Paragraph II of the Constitution of 
the State of Georgia; and, 

WHEREAS, the principal witness for the State at each of 
the judicial proceedings against Freddie Davis was the 
codefendant William Spraggins, who now has stated in open 
court that his testimony against Freddie Davis was false, and 
whose previous testimony, therefore, may no longer be deemed 
to be of sufficient credibility to support another’s sentence 
of death; and, 

WHEREAS, the objective facts present in this particular 
case establish among the two codefendants a common degree of 
criminal culpability shared equally between themselves 
warranting equal punishment for both; 

IT IS HEREBY ORDERED by the Members of the State Board 
of Pardons and Paroles that the sentence of death imposed on 
Freddie Davis be commuted this day to a sentence of life 
imprisonment.

Dear Jack: 

Enclosed is a document we received from an inmate on death row 
in Florida. As you can see, he has prepared a petition for 
commutation for Warren McCleskey. Obviously this is not something 
that you will want to use, but it may have something useful in it. 
I have had it on my desk for sometime to review, in order to try 
to save you effort of reviewing it, but I have simply been unable 
to get to it. Therefore, I am sending it on to you for whatever 
it is worth. 

Karima would like to know any reaction you might have to it, 
so that she can correspond with the fellow in Florida to let him 
know what has been done with his work. 

We are assuming that no news is good news from you. We hope 
not to hear from you for a long time. (Seriously, please let us 
know how things are proceeding, and let know what we should be 
doing from our end to help you.) ;

Belng a sometimes superstitious person, I haves 

hesitated to communicate with you for fear that I would 

upset the quiet which seems to have settled upon us. 

Howaver, I could go on no longer, so here’s a meno to all of 

you. 

Obviously, I have not received a copy of any order from 

Judge Forrester ending our prior federal proceeding. I have 

been expecting lt for some time, and assume it will be along 

shortly. Everything else has been, apparently, equally 

qulat. 

I will be away from my office on business from 

Wednesday afternoon, August 28 through Friday afternoon, 

September 6. I have laft directions wlth my staff that if 

any order comes from either Judge Forrester or the Superior 

Court of Fulton County, Jack Boger should be notified 

immediately. TI have asked Jack to be in touch with you if 

there are any such developments in my absence.
