ON CONSIDERATION WHEREOF, it is ordered and adjudged by this Court 

that the judgment of the above court is reversed with costs, and the case is remanded 

to the United States District Court for the Eastern District of North Carolina for further 

proceedings in conformity with the opinion of this Court. 

IT IS FURTHER ORDERED that appellants James B. Hunt, Jr., Governor of 

North Carolina, et al., recover from Martin Cromartie, et al., One Thousand Five Hundred 

Dollars ($1,500.00) for costs herein expended.
