Dear Doug:
I have spoken with Tiare about the status of the pretrial order. While all parties have been
quite diligent and given a great deal of effort to finalize this pretrial order, numerous edits,
revisions and additions must be made before we will be able to finalize the document in time for
filing at 5 p.m. today. I, therefore, propose that we file a “draft” pretrial order with a letter to the
Court explaining the circumstances, including our extensive efforts thus far to finalize the pretrial
order and our plan to file a final document next Monday. I will contact you to discuss this matter.
