Sherrilyn is doing a first draft, as I toil away on my Supreme Court brief. (I'd love to trade places.) Chambers was scheduled to see Judge Ortique this past weekend, and he will let him know that we won't be moving for an expedited appeal, but will try for a stay of the election. With regard to his suggestion about an intervention to assert a non- remedy, I think the answer to that is clear. The general rule is that the Legislature gets the opportunity to remedy a violation in the first instance. I doubt that the fact that the referendum was defeated would change that rule.
