Re: Chisom v. Roemer
Dear Dr. Quigley:
We are pressing ahead on the appeal. Sherrilyn is doing a
first draft, as I toil away on my Supreme Court brief. (I'd
love to trade places.)
Chambers was scheduled to see Judge Ortique this past
weekend, and he will let him know that we won't be moving for an
expedited appeal, but will try for a stay of the election. With
regard to his suggestion about an intervention to assert a non-
remedy, I think the answer to that is clear. The general rule is
that the Legislature gets the opportunity to remedy a violation
in the first instance. I doubt that the fact that the referendum
was defeated would change that rule. Does my "expert" opinion
comport with yours?

The NAACP Legal Defense & Educational Fund, Inc. (LDF) is not part
of the National Association for the Advancement of Colored People
(NAACP) although LDF was founded by the NAACP and shares its
commitment to equal rights. LDF has had for over 30 years a separate
Board, program, staff, office and budget.
