Dear Judge Wellford:
I am writing in response to the Court's Order of
October 15, 1979, setting a date for an oral hearing
in the above noted case. Unfortunately, I have a prior
commitment on the date picked by the Court for an oral
hearing, Friday, November 30, 1979. I have agreed to
serve as faculty for a lawyer training institute which
will take place here in New York, on Thursday, November
29 and Friday, November 30, 1979. Also, scheduled to
coincide with this event, is a testimonial dinner to
Mr. Jack Greenberg, the Director-Counsel of the NAACP
Legal Defense and Educational Fund, Inc., to celebrate
his thirtieth year at the Fund. I should like to keep
these commitments if at all possible.
Accordingly, I would respectfully request the Court to
reschedule the date of the oral hearing. I would be
available any other day during the week beginning Novem
ber 26th or December 3rd, or any other time at the Court's
convenience.
Thank you for your consideration of this matter. I want
to apologize for any inconvenience this may cause the
Court.
