Hon. Michael Rodak

Clerk

United States Supreme Court
Washington, D.C.

Re: City of Mobile v. Bolden
No. 77-1844

Dear Mr. Rodak:

I would like to request that the date for
filing the Brief for Appellees in the above
case, now December 20, 1978, be extended to

January 16, 1979.

This ‘case will be argued in February
together with Williams v. Brown, No. 78-357.
In Williams the brief for Appellants is due
on December 14, 1978; allowing for mailing
the Appellees' brief in that case would be
due on about January 16, 1979. Our office
represents the Appellees in both these cases,
which present closely related issues, and we
would like an opportunity to study the Appellants’
brief in Williams before responding in Bolden.
In addition, I am personally responsible for
two other cases in which we anticipate filing
Petitions for Certiorari prior to Christmas.

Because of the schedule in Williams,
granting the requested extension in Bolden
will in no way affect the date on which Bolden
will be argued.
