Dear Tiare;

You have designated Dr, Engstrom as a rebuttal witness. By now he has had several months
access to Dr. Weber's reports, testimony and data. If he has specific criticisms or different results
from his analyses, we expect an opportunity to review these calculations. Please forward any
charts or documents you intend to offer into evidence through Dr. Engstrom right away.

To the degree you are truly utilizing Dr. Engstrom for substantive expert testimony rather than

truly as a rebuttal witness for new matters first discussed at trial, we consider that we are entitled
to a brief letter report at a minimum of his major conclusions and analyses.

Yours Very Truly,

Doug ve 70
