INTERROGATORIES AND REQUESTS FOR PRODUCTION
The state defendants in this action answer as follows to Plaintiff-
Intervenors' Second Set of Interrogatories and Requests for Production of
Documents, served on May 17, 1989:
Interrogatory No. 1: Explain and describe whether you oppose or do not
support the election of district judges in the state of Texas from single
member districts smaller in size than an entire county, including but not
limited to, why you do or do not support the use of such an electoral
scheme for the election of district judges in Texas, and whether you
contend that the election of judges from single member districts would
undermine any state policy or rationale related to district judges.

As we understand the question, it first must be pointed out that each
of the State Defendants is sued in his official capacity only. These answers
are given in light of that fact. State district judges in Texas already are
elected from single member districts. Article 5, § 7a(i) of the Texas
Constitution embodies the people's policy choice not to permit those
districts to be smaller in size than a county unless specified preconditions
are met.

Interrogatory No. 2: Explain and describe whether or not you oppose or
do not support the use of a non-exclusionary at large system, such as
limited or cumulative voting, for the election of district judges in Texas,
including but not limited to, why you do or do not support the use of such
an electoral scheme for the election of district judges in Texas, and
whether you contend that the election of district judges using such an
electoral scheme, would undermine or violate any state policy or rationale
related to district judges.
Answer to Interrogatory No. 2:
The current system for electing state district judges is "non-
exclusionary." It also is a single member district system. Because state
law currently does not contemplate the use of either cumulative or limited
voting, using it would contravene the state's policy as expressed in its
constitution and statutes. As you are aware, one of the State Defendants,
Chief Justice Phillips, recently discussed cumulative voting in his
deposition.
