ORDER
Upon an independent evaluation of this matter and upon
consideration of the recommendation of the United States Magistrate
Judge entered on September 30, 1993, it is the ORDER, JUDGMENT, and
DECREE of the court:
(1) That the recommendation of the United States Magistrate
Judge is adopted;
(2) That the redistricting plan proposed by the plaintiffs is
approved and adopted; and
(3) That defendant Town of Fort Deposit and its agents,
officers, employees and all persons acting in concert with the
defendant or at its direction be and are hereby ENJOINED and
RESTRAINED as follows:
(a) From failing to conduct elections for defendant Town
of Fort Deposit under the redistricting plan as approved and
adopted by the court; and
(b) From failing to conduct as soon as practicable new
elections for members of the city council of defendant Town of Fort
Deposit.
It is further ORDERED that the defendant Town of Fort Deposit
submit to the court a schedule and plan for the conduct of the new
elections within 15 days from the date of this order.
