TO THE CLERK OF THE COURT OF APPEALS 

FOR THE FIFTH CIRCUIT: 

You are hereby notified that the defendants-appellees (other 

than the United States of America) in all of the causes which 

have been consolidated for the purposes of appeal under the above 

captions and docket numbers are preparing and will file with the 

Supreme Court of the United States a petition for writ of certi- 

orari. The petition for rehearing of the judgment entered and 

opinion rendered by the Court of Appeals for the Fifth Circuit 

was entered on October 9, 1969, and this petition will be filed 

with the Supreme Court of the United States on or before January 

7, 1970. Rule 23(5) of the Rules of the Supreme Court of the 

United States is as follows: 

5. Where several cases are sought to be reviewed on 
certiorari to the same court that involve identical 
or closely related questions, it shall suffice to 
file a single petition for writ of certiorari cover- 
ing all the cases. 

Under the Rules of the Supreme Court, including Rule 21 and 

Rule 24 (4) thereof, the petitioners are required to file a tran- 

script of the record in the case or cases sought to be reviewed 

upon certiorari, which would, in these cases, include both the 

entire record of pleadings, proceedings, judgments, orders, etc., 

in the Court of Appeals for the Fifth Circuit and the appellate  



  

record from the United States District Court for the Southern 

District of Mississippi, which became a part of the record of 

this Court upon appeal hereto by the appellants. 

You are hereby requested to certify and transmit to the 

Supreme Court of the United States the entire record in these 

proceedings in accordance with the Rules of the Supreme Court of 

the United States.
