STATE'S RESPONSE IN OPPOSITION TO CHIEF JUSTICE THOMAS K. PHILLIPS' 
MOTION FOR ALLOCATION OF TIME FOR ORAL ARGUMENT 

The Attorney General of Texas, on behalf of the State of Texas, opposes the motion by 

Chief Justice Phillips, as Chair of the Texas Judicial Districts Board, that fifteen minutes of oral 

argument time be allotted to him. The reason for this opposition is identical to the reasons stated 

in the state's previously filed motion to disqualify Chief Justice Phillips’ independent counsel 

from further appearance in this case. Through a Court order of April 19, 1993, that motion to 

disqualify is being carried with the case. 

The essence of the motion to disqualify, and of this opposition, is two-fold: (i) the state, 

not any single named official-capacity state defendant, is the real party in interest; and (ii) the 

state in this setting must be treated as an indivisible unit which speaks to this Court through the 

duly elected Attorney General of the state. Against this legal backdrop, the motion for allocation 

of oral argument time to the Chief Justice's independent counsel should be denied.
