FOR LEAVE TO FILE BRIEF EXCEEDING
SEVENTY TYPED PAGES
Plaintiffs-Appellees, Wiley L. Bolden, et al., move this
Court, pursuant to Local Rule 13(g), for leave to file a
brief in excess of the page limitations of Rule 28(c), Federal
Rules of Appellate Procedure. As grounds for their motion,
Plaintiffs-Appellees would show as follows:
1. The brief of Defendants-Appellants, City of
Mobile, et al., filed on or about April 10, 1977. contains
a multifaceted attack on the extensive findings of fact made
by the district court and several involved constitutional
arguments. The record in this appeal contains over 2100 pages
and over 160 documentary exhibits. Yet the statement of the
case and the statement of facts set out in the brief of
Defendants-Appellants is abbreviated and seriously incomplete.
2. In spite of its inadequate presentation of
the evidence, Defendants-Appellants' printed brief is 65
pages long. By order dated April 19, 1977, this Court granted
Defendants-Appellants leave to file their brief in excess of
the fifty-page limitation.
3. Plaintiffs-Appellees will be unable adequately
to outline the relevant facts in this lengthy record and
respond to all of the arguments advanced by Defendants-
Appellants without exceeding the seventy-page length permitted
for typed briefs by Rule 28(g).
WHEREFORE, Plaintiffs-Appellees pray that the Court will
grant them leave to file a brief containing not in excess of
ninety pages of printing by process of duplicating or copying
other than typographic printing.
