MOTION OF PLAINTIFFS TO ALTER OR AMEND ORDER 
  

PLEASE TAKE NOTICE that plaintiffs in the above-captioned 

action respectfully move, pursuant to Rule 59 (e) of the Federal 

Rules of Civil Procedure, tO alter -or amend the Order of the 

Clerk of this Court, dated October 30, 1980, dismissing the 

 



  

above-captioned actions, to conform to the motions presented 

to this Court and the judgment signed by this Court on 

October 24, 1980. In particular, plaintiffs' request that 

the Order be altered or amended in the following particulars: 

1. The Orders which dismiss the entire actions be 

withdrawn; 

o The amended Order should dismiss plaintiffs' application 

for attorney fees and costs, and the "State-wide" causes of 

action against William T. Paynter, M.D., As State Health 

Commissioner for the Indiana State Board of Health; James 

White, As Director of the Division of Hospital and Institutional 

Services of the Indiana State Board of Health; and David J. 

Edwards, M.D., As Director of the Health Facilities Services and 

Review Development Bureau of the Indiana State Board of Health. 

The grounds for this Motion, which are set forth with 

specificity in the accompanying Affidavit of Julian B. Allen, 

Esq., filed in support of this Motion, are that the.Orders of 

the Clerk of this Court do not conform to either the Motion or 

Judgment of this Court, and the Consent Decree approved and 

signed by the Honorable Phil McNagny dated July 17, 1979.
