Dear Paul:
I really appreciated your coming to San Antonio to
do the section 5 workshop with ne; I'm only sorry ne
didn't get more tine to talk. f thought what you said
about using the intent prong of section 5 was
interesting. ft ties in with what te're finding with
Dillard v. Crenshaw Countv (fI)--proving intent gives
litigants freedom to do a lot nore than we can do in a
straight results case, both with respect to the breadth
of coverage and with respect to getting around some
defendants' overly literal reading of Ginqles.
I finally got the three-judge court's opinion in
Jones v. Edwards. It was pretty much what I expected,
putting a huge amount of faith in the ability of a
registrar who screwed up every stage of the process to
perfom the final step properly. But I hlas glad we
picked up Judge Rubin. We'Il wait to see whether the
section 2 claim is worth pursuing.
Have you been able to get the section 2OB
materialE and the case list together? There's no
incredible rush from this end, but I think we'd like to
get the manual done by the end of November.
