areas of defendant, and the specific steps taken or planned by
defendant to eliminate racial discrimination in the Charlotte-
Mecklenburg public schools since the Supreme Court decision in
Brown v. Board of Education.
5. Defendant has requested an extension of time to answer
interrogatories, contending (1) that the plaintiffs contemplate
prosecuting this action on the basis of past practices of defend-
ant with a:-request for information as to future plans: (2) that
| defendant is now engaged in an extended review of its policies
contemplating establishing a broad new program which it hopes to
present to the Court not later than April 1, 1965 or May 1, 1965;
(3) that any consideration of this case on the merits will be
based upon the policies of defendant then in effect; and (4) that
| the extension requested will not unduly prejudice plaintiffs with | respect Co relief for the fortheoming school terms.
2. The plaintiffs seek here relief against defendant's
| eiseriminatory practices commencing and being implemented during

| the ensuing school term.

6. The information sought by plaintiffs’ interrogatories,
| particularly with respect to school zone lines or attendance
areas and assignment of teachers and professional school person-
nel, will require further study by plaintiffs in preparation of
their case in the hearing of this cause on the merits. In this
connection, the policies and practices of defendant with respect
to the assignment of students, teachers and school personnel
which are presently in force are pertinent and material to the
|hearing of this cause on the merits and such information is
presently available to defendant. Such information will also be

pertinent and material to any consideration of any future policies
and practices adopted by defendant.
