MOTION TO ALLOW FILING OF PLAINTIFFS®
OPPOSITION MEMORANDUM OUT OF TIME
Plaintiffs move the Court to allow it to file the attached
memorandum in opposition. The arguments presented by plaintiff
in the attached memorandum were made in their entirety as early
as plaintiffs brief of February 15, 1985, when this matter was
initially considered by the U.S.Magistrate. There is no surprise
or prejudice to the defendants. The issues presented by the
defendants motion and the plaintiffs’ opposition thereto are not
complex and should not delay court proceedings. Undersigned
counsel apologizes to the Court for filing out of time on this
matter. a
