I,FFIDAVIT OF SOIOMON S. SEAY, JR.

Before me, the undersigned Notary Public of the State of

Alabama at Iarge, personally appeared Solomon S. Seay, Jr., who

by me first being duly sworn accord.ing to 1aw, on his oath deposes

and says:

My name is Solomon S. Seay, Jr.i I am over the age of
twenty-one yearsi a citizen of the United States and of the State

of Alabama, and reside in the City of Montgom€ry, Alabama.

I am an Attorney at Law duly licensed and authorized to
practice before the Courts of the State of alabama. I am one of
the Attorneys of record for Maggie Bozeman, Defendant in the above

styled causer and represented Maggie Bozeman at the trial of her

case in the Circuit Court of Pickens County

According to the 1970 Decennial Census (a copy of the relevant
portion thereof being attached hereto) of which the Courts of the

State of Alabama take judicial notice, there are 8,159 white persons

18 years of age and older residing in Pickens County, and there are

4,456 non-white persons 18 years of.q" and older residing in Pickens

County. Thus non-whites comprise approximately 35? of the age-eligible
for jury duty residents of Pickens County.



The Venire of jurors drawn for jury service on October 30,

1979 contained the narnes of 63 persons, 49 of whom were present

and qualified to serve. Of the 49 persons present and qualified

to serve, 9 (188) were Black.

The State !{as awarded 13 strikes and the Defendant had 24

strikes (a copy of the Jury Strike Sheet is attached hereto).

The State used its strikes to systematically exclude all

Blacks from jury service by reason of their race or color, and in
contravention of Article L, Section 6 of the Constitution'of

Alabama of 1901, and the due process and equal protection clauses

of the Fourteenth Amendment to the Constitution of the United

States. Defendant was thereby deprived of a fair, just and imparEial

trial.
