The motion filed by the NAACP as amicus curiae on 

behalf of named Lawrence County Negro parents and children 

seeking supplemental relief with regard to the order of this   
court dated November 26, 1969, which order modified the order

of November 6, 1969, is granted as follows. 

It is ordered, adjudged and decreed that: 

(1) movants be and they are hereby allowed to inter- 

vene as parties plaintiff in the Lawrence County case; .   (2) the substitute plan of desegregation approved 

by this court in its order of November 26, 1969, shall be

tested in an evidentiary hearing before the Honorable Dan M. 

Russell, Jr., in accordance with the procedures set out in 

the order of this court dated November 7, 1969; 

(3) ‘the burden of proof in that hearing shall be 

upon defendants to demonstrate that the substitute plan was bs 

devised and promulgated for education purposes only; and 

(4) in the absence of such a showing by defendants, 

the Office of Education (HEW) plan of desegregation shall be
