RE: Bozeman and Wilder v. Lambert

Dear Vanzetta: ,

Please call me immediatley so that we can d.iscuss our
response to the Staters answer. The State sent me a
padcage containing a copy of Wilder's transcripts,
labelled "J. " This package does not contain any of the
material we requested in our Motion to produce.
Although I have not received the Bozema[ transcript
from the State, I am confident itE also not whal we
need, and in fact is a copy of what we already have.

Our Motion to Produce referred. specifically to the
prosecutorrs closing argument in Bozeman, and in both
Bozeman and Wilder we asked for cop-Ies of out-of-court
statements uffif the prosecutor t,o impeach his own
witnesses.

I need to d.iscuss with you how best to bring the State's
complete failure to answer our motion to the attention
of the court, Shou1d I prepare a formal reply, a further
motion to produce or will a telephone call to the judge's
clerk suffice?

I look forward to your telephone caII. I can be reached
in my office Tuesday or Wednesday afternoons.
