Re: Cromartie Pretrial Order 

Dear Sirs: 

Counsel for the parties previously corresponded with the Court offering a proposal for the 

content and timing of a final pretrial order in this case. In light of the recent order continuing the trial 

from November 1, 1999, to a time still to be determined, counsel have again conferred and agree that 

the additional time can be put to good use because it will allow the parties more time to work on the 

content of the pretrial order. 

Counsel will continue to take steps to facilitate the pretrial process and hope to confer next 

week to propose a new time frame for completing the final pretrial order under the less narrow time

constraints which now exist. Once a trial date is established, it will be possible to finalize a pretrial 

order that the parties hope will be acceptable to the Court. Any guidance which you can offer in 

preparing for the trial of this matter will be appreciated.
